1. Agreement to Terms

By accessing or using any services provided by IPPTR, a platform operated by IPPTR ("Company," "we," "us"), you ("Customer," "you," "your") agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

2. Description of Services

IPPTR provides the following categories of services, subject to the terms outlined herein:

DNS Services

Managed DNS hosting, Premium DNS, Private DNS servers, Dynamic DNS, Reverse DNS, GeoDNS, and DNS Failover monitoring.

Data Center Services

Dedicated servers, cloud hosting, private cloud, co-location, shared hosting, domain registration, and SSL certificates.

IP & Network Services

IP monitoring, blacklist monitoring, network monitoring, ISP services, NOC services, and infrastructure management.

Free Tools

DNS lookup tool, IP blacklist checker, and other diagnostic utilities provided at no charge for general use.

3. Account Registration & Responsibilities

  • You must provide accurate, current, and complete information during registration and keep your account details updated.
  • You are responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens.
  • You are liable for all activities that occur under your account, whether authorized by you or not.
  • You must notify us immediately upon becoming aware of any unauthorized access to or use of your account.
  • Accounts are non-transferable without prior written consent from IPPTR.
  • You must be at least 18 years of age to create an account and use our services.

4. Acceptable Use Policy

You agree not to use our services for any unlawful, abusive, or prohibited purpose. The following activities are strictly prohibited:

  • Distributing malware, viruses, ransomware, or any malicious software through our infrastructure.
  • Sending unsolicited bulk email (spam), phishing attempts, or fraudulent communications.
  • Launching or facilitating denial-of-service attacks, port scanning, or network intrusion against any target.
  • Hosting or distributing illegal content, including but not limited to child exploitation material.
  • Infringing upon intellectual property rights, trademarks, or copyrights of third parties.
  • Attempting to gain unauthorized access to our systems, other customer accounts, or third-party networks.
  • Using our services to engage in cryptocurrency mining without explicit authorization.
  • Overloading, disrupting, or interfering with our infrastructure or other customers' services.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without prior notice or refund.

5. Payment Terms

  • Billing Cycle: Services are billed in advance on a monthly, quarterly, or annual basis depending on the selected plan.
  • Payment Methods: We accept major credit cards, PayPal, bank transfers, and other payment methods as displayed during checkout.
  • Late Payments: Accounts with overdue balances may be suspended after a 7-day grace period. A late fee of 1.5% per month may apply to outstanding amounts.
  • Price Changes: We reserve the right to modify pricing with 30 days advance notice. Price increases apply at the next renewal cycle, not mid-term.
  • Taxes: Prices are exclusive of applicable taxes. You are responsible for all taxes, duties, and levies imposed by your jurisdiction.
  • Refunds: Refund requests are evaluated on a case-by-case basis. Domain registrations and SSL certificates are non-refundable once provisioned.

6. Service Availability & Maintenance

We strive to maintain high availability across all services. However, you acknowledge that:

  • Scheduled maintenance windows are communicated at least 48 hours in advance via email and our status page.
  • Emergency maintenance for critical security patches or infrastructure failures may occur without prior notice.
  • While we target 99.99% uptime, brief interruptions may occur due to factors beyond our reasonable control.
  • Specific uptime commitments and service credits are governed by our separate Service Level Agreement (SLA).

7. Intellectual Property

  • All content, software, trademarks, logos, and materials on ipptr.com are the intellectual property of IPPTR.
  • You retain ownership of your data, DNS configurations, and content hosted through our services.
  • You grant us a limited license to process, store, and transmit your data solely for the purpose of delivering our services.
  • You may not reproduce, modify, distribute, or reverse-engineer any part of our platform without written permission.

8. Data Backup & Customer Responsibility

While we maintain redundant systems and perform regular backups, you are ultimately responsible for maintaining independent backups of your data, DNS zone files, and configurations. We are not liable for data loss resulting from hardware failure, software errors, security breaches, accidental deletion by the customer, or events beyond our reasonable control. We strongly recommend implementing your own backup strategy for all critical data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, IPPTR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities. Our total aggregate liability for any claims arising under these terms shall not exceed the amount you paid for services during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless IPPTR, their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of our services, violation of these terms, infringement of third-party rights, or content you host or transmit through our infrastructure.

11. Termination

  • By You: You may cancel your services at any time through your client portal or by contacting support. Cancellations take effect at the end of the current billing period.
  • By Us: We may suspend or terminate your account for violation of these terms, non-payment, abuse, or at our discretion with 30 days written notice.
  • Immediate Termination: We reserve the right to terminate accounts immediately and without notice for serious violations including illegal activity, abuse, or actions threatening the security of our infrastructure.
  • Post-Termination: Upon termination, your access to services will cease. We may retain data for a reasonable period to comply with legal obligations, after which it will be securely deleted.

12. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, acts of war or terrorism, government actions, power outages, internet backbone failures, telecommunications disruptions, pandemics, or severe weather events.

13. Dispute Resolution

Any disputes arising under these terms shall first be addressed through good-faith negotiation between the parties. If negotiation fails to resolve the dispute within 30 days, either party may pursue resolution through binding arbitration or through the courts of competent jurisdiction. These terms are governed by applicable laws without regard to conflict of law principles.

14. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of our services after changes become effective constitutes your acceptance of the modified terms. If you disagree with any changes, you may cancel your services before the effective date.

15. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
